Scope: NOXSIGN Player application (Android, Windows).
This agreement sets out the terms on which you may use the NOXSIGN Player application. By installing, opening or continuing to use the application you accept these terms. If you do not accept them, do not use the application and remove it from your device.
1. Parties and Definitions
1.1. This agreement is concluded between İSKAY BİLİŞİM — İSKAY SOFT (hereinafter "İskay Soft" or "we") and the natural or legal person using the application (hereinafter "the User" or "you").
1.2. Application: NOXSIGN Player, a media player running on Android phones, tablets and media boxes and on Windows computers. This agreement applies to the Application as a whole, regardless of the platform on which it is used.
1.3. Source: The portal address, user name, password or playlist address of a broadcast subscription that the User obtains from a third party and enters into the application.
1.4. Licence: The right of use granted by İskay Soft that allows the application to run on a given device.
2. Subject Matter
2.1. This agreement determines the terms and limits under which the application is licensed to the User.
2.2. The application is not sold; a right of use is licensed. All intellectual and industrial property rights in the application belong to İskay Soft.
3. Scope and Limits of the Licence
3.1. İskay Soft grants the User a non-transferable, non-exclusive right of use that may not be sub-licensed and that is subject to the terms of this agreement.
3.2. The licence applies to the device or devices for which it is issued. The number of devices is determined by the licence purchased.
3.3. The User may not decompile, reverse engineer, modify, reproduce, rent, lend, sell the application or make it available to third parties, save where mandatory provisions of applicable law permit otherwise.
3.4. The User may not disable or circumvent the licence verification mechanism, nor use third-party tools for that purpose.
4. Trial Period, Fees and Term
4.1. The application may be offered as a free trial for a limited period upon first installation. The trial period and its terms are notified separately at the time of purchase.
4.2. When the trial period or the licence term ends, playback stops. Personal settings and source details stored on the device are not deleted; only playback ceases.
4.3. Commercial terms such as price, term, renewal and device count are determined by the sales document issued to the User at the time of sale.
4.4. İskay Soft reserves the right to suspend licences that are unpaid, cancelled or found to be misused. Suspension takes effect at the next licence verification.
5. Content — The Key Provision
5.1. İskay Soft is not a broadcaster or content provider. The application does not provide, offer, host, retransmit or index any television channel, film, series or other content, and does not sell subscriptions for access to content.
5.2. The application is only a player. All content comes from the Source entered by the User and flows directly from the User's provider to the User's device. At no point does content pass through İskay Soft's servers.
5.3. The application, its source code, its installation package and its default settings contain no broadcast address, channel list, content index, user name or password.
5.4. The User is solely responsible for the lawfulness of the Source used, for holding the necessary permissions, and for complying with that Source's own terms of use.
5.5. İskay Soft gives no undertaking and accepts no liability as to the lawfulness, accuracy, quality, continuity or uninterrupted availability of the content accessed by the User.
6. User Obligations
6.1. The User may not use the application in breach of applicable law, the rights of third parties, or public morals.
6.2. The User may not use the application to access copyright-protected content without the rights holder's permission.
6.3. The User may not share licence details or the pairing key with third parties.
6.4. The User is responsible for the confidentiality of their own source credentials. These are stored encrypted on the device and are not transmitted to İskay Soft.
7. Updates
7.1. The application may check for new versions on its own and notify the User.
7.2. On personal devices such as phones and tablets, updates are not installed without the User's confirmation. On media boxes managed in the field, updates may be applied automatically according to the configuration made at installation.
7.3. Updates are published to fix defects, improve security or enhance functionality. İskay Soft reserves the right to change features.
8. Warranty and Limitation of Liability
8.1. The application is provided "as is". İskay Soft does not warrant that it will operate without interruption or error on every device, network condition and source.
8.2. İskay Soft is not liable for problems arising from the User's own source, internet connection, device or third-party services.
8.3. İskay Soft's total liability under this agreement is in any event limited to the licence fee paid by the User for the relevant period.
8.4. The limitations in this article do not apply in cases of intent or gross negligence, or where applicable law does not permit limitation of liability.
9. Termination
9.1. The User may terminate this agreement at any time by removing the application from their device.
9.2. İskay Soft may suspend the licence and terminate this agreement in the event of a material breach.
9.3. Termination does not affect rights and obligations that have already arisen.
10. Governing Law and Jurisdiction
10.1. This agreement is governed by the laws of the Republic of Türkiye.
10.2. The courts and enforcement offices of Kırşehir have jurisdiction. Provisions on the jurisdiction of consumer arbitration committees and consumer courts are reserved for Users who qualify as consumers.
11. Amendments and Entry into Force
11.1. İskay Soft may amend this agreement. Amendments take effect when published within the application.
11.2. By continuing to use the application after an amendment, the User is deemed to have accepted the new terms.
